90 Day Fitness Challenge Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

This 90 Day Fitness Challenge (hereinafter as “Sweepstakes”) is governed exclusively by the laws of the United States and is limited to the legal residents of the fifty (50) United States and the District of Columbia, excluding New York, Florida, Alaska, Hawaii, and Rhode Island (DOES NOT INCLDUE CANADA, PUERTO RICO, AND OTHER US TERRITORIES & POSSESSIONS).

1. DATES OF SWEEPSTAKES. The Sweepstakes begins at 12:00:01 p.m. Pacific Time (“PT”) on July 15, 2022 and ends at 11:59:59 p.m. PT on September 28, 2022 (the “Entry Period”).
2. ELIGIBILITY. Open only to legal residents of the 50 United States and D.C., excluding residents of New York, Florida, Alaska, Hawaii, and Rhode Island, who are eighteen (18) years of age and older as of the date of entry and have access to an Etekcity Smart Fitness Scale. Employees and directors of Etekcity Corporation (“Sponsor”) and its parents, subsidiaries, affiliates, and agencies (“Promotion Parties”) are not eligible, nor are persons involved in the execution or administration of this promotion, or the family members of each above (parents, children, siblings, spouse/domestic partners, or individuals residing in the same household). Void outside of the specified states, the District of Columbia, and where prohibited, taxed or restricted by law.
3. HOW TO ENTER. NO PURCHASE NECESSARY TO ENTER OR WIN. You can enter the Sweepstakes by registering on the landing page at etekcity.com/90-day-fitness-challenge (the “Landing Page”) and following the instructions below.
   • GRAND PRIZES. Participants must: follow the Etekcity Instagram page at www.instagram.com/etekcity/ or join the Etekcity 90 Day Fitness Challenge Facebook group at facebook.com/groups/e90challenge; set a fitness goal on the VeSync mobile app; post one (1) image or video on Instagram or the Etekcity 90 Day Fitness Challenge Facebook group page with the hashtags #etekcity, #etek90, and #week[number] every week for at least six (6) weeks during the Entry Period; share one (1) monthly progress post with the Campaign Monitor in the VeSync app; and share one (1) “before” photo and one (1) “after” photo, after the six (6) or more weekly posts have been posted, to Instagram or the Etekcity 90 Day Fitness Challenge Facebook group page with the hashtags #etekcity, #etek90, and #week[number].
   • WEEKLY DRAWINGS. For each weekly drawing that participants wish to enter, participants must like the Etekcity 90-Day Fitness Challenge post on Instagram or the Etekcity 90 Day Fitness Challenge Facebook group page and post one (1) image or video on Instagram or the Etekcity 90 Day Fitness Challenge Facebook group page with the hashtags #etekcity, #etek90, and #week[number] every week during the Entry Period that participant would like to enter the weekly drawing. Participants may enter weekly drawings between Friday at 12:00:01 a.m. PT and the following Wednesday at 11:59:59 p.m. PT.
   • INVITE A FRIEND PRIZES. From the Landing Page, participants must share the Sweepstakes’ registration form with their friends by entering their friends’ email addresses in the proper field. The participants’ friends will be given a registration code and must use the registration code to register themselves. When the participants’ friends (i) enter the Sweepstakes; (ii) register using the provided registration code; (iii) follow all rules governing the grand prizes; and (iv) win a grand prize, the referring participant will automatically be entered to win one (1) Invite A Friend prize.

Participants’ social media profiles must be public for the duration of the Sweepstakes, and participants may not change their social media handles or names for the duration of the Sweepstakes. Participants must use the same email address to register for the Sweepstakes and for their VeSync account.

No more than one entry per person is permitted, unless otherwise stated in the instructions. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, accounts, or devices in an attempt to circumvent the rules.

4. WINNER SELECTION.
   • GRAND PRIZES. Drawings for the grand prizes will be held on October 7, 2022 at 12:00:00 p.m. PT.
   • WEEKLY DRAWINGS. Each weekly drawing will be held for the prior week every Friday at 12:00:00 p.m. PT. There is a limit of one (1) Weekly prize per person/social media account.
   • INVITE A FRIEND PRIZES. Drawings for the Invite A Friend prizes will be held on October 7, 2022 at 12:00:00 p.m. PT. There is a limit of one (1) Invite A Friend Prize per person/social media account.

Winners will be randomly drawn by the Sponsor. The decisions of the Sponsor are final and binding in all respects. The odds of winning will be based on the number of eligible entries received. Potential winners will be notified by email and by post on Etekcity’s Instagram story and highlights, the Etekcity 90 Day Fitness Challenge Facebook group page, and on the Etekcity and VeSync email newsletters with last names hidden. Potential winners must follow all requirements set forth in the notification. Failure to respond within thirty (30) days will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. Sponsor shall have no liability for any potential winner notification that is not received by any potential winner for any reason. If there is an insufficient number of eligible entries, Sponsor reserves the right to terminate this Sweepstakes without awarding any prizes. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this Sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters.  Acceptance of a prize also constitutes permission to the Promotion Parties to use winner’s public account information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

5. PRIZES.
   • GRAND PRIZES: The first-place winner may choose to receive: one (1) Nordic Track Fusion CST Studio (approximate retail value of $2,500.00); one (1) Peloton Bike+ (approximate retail value of $2,500.00); or one (1) Hydrow Rower (approximate retail value of $2,500.00). The second-place winners will receive up to $1,000 applied to up to two (2) years of a membership to a gym of their choice. The third-place winner will receive a Therabody Theragun Pro (approximate retail value of $500.00). Shipping is included for all grand prizes.
   • WEEKLY PRIZES: The winners of the weekly prizes may, in Sponsor’s sole discretion, receive: one (1) of ten (10) available Levoit Core 300S Smart true HEPA Air Purifiers (approximate retail value of $150.00); one (1) of ten (10) available Cosori Dual Blaze 6.8-Quart Smart Air Fryers (approximate retail value of $180.00); one (1) of forty (40) available Etekcity ESN00 Nutrition Scales (approximate retail value of $30.00); or one (1) of forty (40) available Etekcity Luminary Nutrition Scales (approximate retail value of $35.00). Shipping is included for all weekly prizes.
   • INVITE A FRIEND PRIZES: The winner(s) of the Invite a Friend prizes will receive one (1) of three (3) available Amazon Gift Cards (approximate retail value of $250.00).

Winners will receive the prizes in the manner specified in the Sweepstakes’ instructions. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded if the prizes’ corresponding criteria are met. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied offered by Sponsor. Sponsor shall not be responsible for any delays, damage in the delivery of the prize, and/or loss of any prize in connection with delivery of the prize via mail.

6. LIMITATION OF LIABILITY: By entering this Sweepstakes, entrants waive all right to, and hold the Promotion Parties harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right to, in its sole discretion, cancel or modify this Sweepstakes in a manner deemed appropriate by the Sponsor. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name of the account holder.
7. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of California, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Sweepstakes and these Official Rules shall be brought exclusively in the applicable federal or state courts located in Orange County, California.
8. PRIVACY. Personal information will be used in accordance with the L&H Y Trading Inc.’s Privacy Policy and mobile app Terms of Use.
9. WINNERS LIST. All winners’ names will be listed and made available on October 7, 2022, at 12:00 p.m. PT on the Landing Page, Etekcity Instagram highlights, the Etekcity 90 Day Fitness Challenge Facebook group page, and the Etekcity and VeSync email newsletters.
